Assisting the Government in Policy formulation on the administration of
Juvenile Justice, Prevention and combating trafficking and commercial sexual
exploitation of children and women.
Running programmes and activities for children in
difficult circumstance like street children, children of prostitutes and
children from families whose parents are infected by communicable diseases like
HIV / AIDs.
Ensuring protection and development of children and
women from significant harm through institutional, non-institutional and
out-reach programmes.
Co-ordination and networking with allied systems like
Police, Judiciary, Civil society, NGOs, Corporate sector etc., to ensure
protection and development of children and women who are living in vulnerable
condition.
Running and Maintaining of child care institutions like
Observation Homes, Special Homes, Shelter Homes, drop in centres, children's
homes etc., under the provision of Juvenile Justice (Care and Protection of
children) Act, 2000 either on its own or in collaboration with NGOs.
Running and Maintaining of institution like Rescue
Shelters, Vigilance Institution / Protective Homes etc., under the provision of
Immoral Traffic (Prevention) Act, 1956 either on its own or in collaboration
with NGOs.
Running and maintaining of special care centres like short-stay homes, Half-way homes, for providing Care and Protection
to girls and women as per the policies of State and Central Governments to
protect girls and women from abuse, exploitation etc.,
To facilitate the implementation of the
integrated programme for street children and the schemes for the prevention of
alcoholism and substance (drug) abuse, of the Ministry of Social Justice and
Empowerment, Government of India. Schemes under grant in aid by Government of
India in the Ministry of Women and Child development and in the Ministry of
Social Empowerment for innovative projects.
To encourage active participation of academic
institutions by volunteers and NGOs in providing counseling and guidance service
by establishing Juvenile Guidance Centre, Crisis Intervention Programmes etc.,
In Part II Scheme for 2004-05, five counsellers on consolidated pay of
Rs.3500/-per month has been sanctioned for five centers at Vellore, Coimbatore,
Tirunelveli, Tanjore and Trichy.
GUIDING FACTORS FOR PROBATION RELATED WORKS
Probation of offender is the universally accepted,
effectively tried and widely practised non-institutional method. It is being
used by Judiciary at their discretion to treat and rehabilitate a variety of
selected offenders, especially young persons, without sending them to prison.
Probation is a method of dealing with offenders
within the Community. It was developed as an alternative to imprisonment or institutionalisation which is applicable to cases where guilt is established but
where the judiciary considers that imposing of a prison sentence would do no
good.
Probation is a conditional suspension of punishment.
This pre-supposes that the released offender is not likely to resume a criminal
carrier. It provides for assistance to the probationers in the form of personal
supervision and guidance during the probation period of the Probation Officer.
According to United Nations Department of Social
Affairs 1951 (Probation and related measures) probation is the process of
treatment prescribed by the Court for persons convicted of offences against the
law during which the individual or probationer lives in a community and regulate
his own life of conditions imposed by the Court or other constituted authority
and subjected to supervision by a Probation Officer.
The overall goal of correctional system is to
rehabilitate the offender. Probation and related measures constitute an integral
part of the more general movement away from the traditional punitive and
repressive approach and towards a more humanitarian and utilitarian
consideration for general deterrence and punishment. Probation concept is not
inflicting, suffering on the client, but rather to prevent the client from
suffering. Probation has two functions namely rehabilitating the offender and
protecting the community.
PROBATION SERVICES
Probation Officers who are eyes and ears of Juvenile
Justice Boards/Child Welfare Committees are to play an important role in the
administration of Juvenile Justice. The primary duties and functions of Probation Officers are as
follows :-

Pre-trail enquiry to facilitate the adjudication agency to decide the
release of a person under 18 years of age on bail or not. |

If
released on bail pre-trail supervision and guidance to children in
conflict with law. |

[3] |
Social
Enquiry Report : While furnishing reports the Probation Officers shall
analyse and diagnose the problems of children through detailed enquiries
and suggest measures for intervention to the adjudication agency to
determine the strategy for intervention. |

CRISIS INTERVENTION CENTER
The
Department supports the Indian Council for Child Welfare, Tamil Nadu financially
to implement Crisis Intervention Centre to provide support services like
shelter, medical care, legal, psychological counselling and guidance to those
children who are abused either physically or sexually. Crisis Intervention
Centre extends the following services:
Rescue
a child from abuse or exploitation or ill-treatment upon information received
through Phone, letters, fax, E-mail, CHILDLINE etc.,

shelter and medical assistance.

Legal and counselling
services and relief.

family and the child.

PREVENTION OF CHILD BEGGARY
Keeping in mind, the best interest principles of
children's developmental needs, the Department of Social Defence supports the
Indian Council for Child Welfare to eliminate child begging. The programme
components include the following:

from further exploitation. |

Provide shelter facilities to such children, talk with them, and
counseling the children and their families. |

Extend support services for pursuing education. |
SCHEMES FOR THE WELFARE OF
STREET CHILDREN BY GOVERNMENT OF TAMIL NADU
Government of Tamil Nadu was supporting Non Governmental Organisations to
provide support services for fifty street and working children in the form of
implementing Night Shelters. State Government extended a financial support of
Rs.65,000/- p.a. per Non Governmental Organisation which may undertake the
following activities.

Provide shelter needs to street and working
children who are otherwise would stay on the streets for survival,
shelter and recreational needs etc., |

Night meal at the centre. |

Provide counseling services. |
In the Part-II scheme for
the year 2004-05 Government of Tamilnadu have sanctioned the comprehensive
Street children programme in which a sum of Rs.225/-has been sanctioned as
maintenance grant per child running night shelters by NGO.
SCHEMES FOR THE WELFARE OF STREET CHILDREN BY GOVERNMENT OF INDIA
Government of India has introduced a scheme called
Integrated Programme for Street Children and extends financial support in
co-ordination with Department of Social Defence upto a maximum of Rs.15 lakhs
for Non Governmental Organisations for providing services upto 300 children. For
