CITIZEN'S CHARTER 2009
PREAMBLE

            The Department of Social Defence is providing services for the development of children found in difficult circumstances and for girls and women who require care, treatment and rehabilitation. The Department is also providing institutional and non-institutional services for the rehabilitation of the children entering the institutions, besides involving the Non-Governmental Organisations in all the programmes to ensure protection of the rights of the children and their all round development. The Department also provides aftercare services to the boys, girls and women discharged from the institutions.

            The Department deals with children under the Juvenile Justice (Care and Protection of Children) Act, 2000 as amended in 2006, and girls and women institutionalised under the Immoral Traffic (Prevention) Act, 1956.

The Commissionerate of Social Defence co-ordinates Drug abuse control and prevention programme of the Ministry of Social Justice and Empowerment, Government of India, and ‘SWADHAR’ and ‘UJJAWALA’ of the Ministry of Women and Child Development, Government of India.

Boys & Girls below 18   found begging or found without any home or settled place of abode and without any ostensible means of subsistence or destitute,  or having a parent or guardian who is unfit or incapacitated to exercise control over the children, or who are likely to be abused exploited for immoral or illegal purpose or unconscionable gain; or runaway, or missing, or victims of trafficking or working, or in street.

 

 

Under Sec 32 of the Juvenile Justice (Care & Protection of Children) Act, 2000, designated  Police Officers, or State Juvenile Police Unit or Childline or public spirited citizen, or recognised voluntary organisation or any public servant are authorised persons to rescue and produce before Child Welfare Committee.

Any behaviour towards a child by any adult, which impairs the child’s physical, mental or emotional health and development and thereby debases, degrades and demeans the dignity of a child. In short abuse takes place whenever there is violation of the rights of a child.

CHILD WELFARE COMMITTEES

 

Eighteen Child Welfare Committees have been constituted under section 29 (i) of Juvenile Justice (Care and Protection of Children) Act, 2000 to deal with cases of children in need of care and protection and are functioning in the following places:

Each Child Welfare Committee consists of a non-official Chairman and 4 Members (including one women member).  The Child Welfare Committee is vested with the powers of Metropolitan Magistrate or Judicial Magistrate of First Class.  The Committee will meet three days in a week (Tuesday, Thursday and Friday) in the premises of the notified homes.

            The details of eighteen Child Welfare Committees constituted under Section 29 of Chapter III of the Juvenile Justice (Care and Protection of children) Act, 2000 is given in Annexure - I.

JUVENILE JUSTICE BOARDS

 

            According to revised Act of 2000, eight Juvenile Justice Boards were constituted under Section 4 (i) of Chapter – II of Juvenile Justice (Care and Protetion of Children) Act, 2000 to deal with cases of the juvenile  in conflict with law  @ Chennai, Tirunelveli, Thanjavur, Salem, Cuddalore, Trichy, Madurai and Coimbatore.  The Boards consists of a Metropolitan Magistrate or a Judicial Magistrate of the first class with two social workers (including one women social worker) having powers conferred by the code of criminal procedure 1973. The Boards will meet three days in a week (Monday, Wednesday and Friday) in the premises of the respective Observation Homes.  The list of Juvenile Justice Boards is shown in Annexure - II.

RESOURCE  CENTRES

            The existing 5 Juvenile Guidance Bureaux  functioning under the Department in Chennai (2 places), Madurai, Vellore, and Coimbatore have been restructured to facilitate creation of Resource Centres with a Social Worker-cum-Counsellor and Psychologist, in 30 districts.  These Resource Centres are to provide psycho social care and guidance to the children referred to them by the Child Welfare Committee / Juvenile Justice Boards. The Resource Centres  are to also provide counselling and guidance to the parents apart from undertaking research programmes on the prevalence of children in conflict with law. These Resource Centres would function through Non-Governmental Organisations with financial assistance from the Government.

REHABILITATION

  1. Incentive is paid to the children according to their skills  being learnt.  The incentive is at Rs.70/- and Rs.50/-per month per child (skilled and semi-skilled) respectively.
  2. As a de-institutionalisation effort, Family Support scheme is implemented. Beneficiaries under this programme are decided by the Child Welfare Committee and placed back with their parents. Financial assistance of Rs.200/-per month per child is provided to the family.
  3. Lump sum assistance Rs.500/- to Rs.2500/- in the form of tools and equipment is provided to the discharged children of Children/ Special Homes trained in the various trades.
  4. Job oriented vocational training courses are offered at Government After Care Organisation, Athur, to the discharged children/juveniles  for their future employment.
  5. Marriage grant of Rs.3000 is sanctioned to the children for whom marriage is arranged by the Department. Rs.2000 is also paid towards marriage day expenses.

The Department of Social Defence is implementing welfare programmes for Street Children with the involvement of Non-Governmental Organisations.

Under the Comprehensive Street Children Programme, 50 children are admitted in each institution and they are provided food, non-formal education and vocational training. These shelters provide a safe place to the street children.  A maintenance grant of Rs.2,70,000/- per annum per shelter (i.e.Rs.450/- per child per month x 50 children x 12 months) is provided.    At present, the Shelters are functioning at the following 7 places.

Apart from these, 1 NGO, Tiruchirapalli Multi purpose Social Service Society, Tiruchi is implementing the Integrated programme for street children.  (300 Children) funded by the Ministry of Social Justice and Empowerment, Government of India. The financial assistance under the GOI Programme is Rs.15 Lakhs (10% shared by the NGOs). There are 6 other NGOs also who  operate street children programmes with shelters.  The list of  these 7 shelters including under the programme assisted by Government of India is given in Annexure - VII.


ERADICATION OF JUVENILE BEGGARY

            To eradicate begging by children, a scheme is implemented through ICCW, Chennai.  The children are persuaded to join schools and the parents are motivated to send their children to schools.

The NGO (ICCW, Shenoy Nagar, Chennai) with the help of Juvenile Aid Police Unit round up the children found begging in the city of Chennai and brings  them before the Child Welfare Committee, and tries to rehabilitate them.

CHILD LINE

Childline India Foundation (C.I.F) was founded in June 1996, which is the Nodal Agency for implementing CHILDLINE services in the cities / districts across India. CHILDLINE, is a national,  24-hour, free, emergency telephone helpline and out-reach service to help a child in distress between the age group of 0-18 years, and provides interventions related to rescue, shelter, medical aid,  repatriation,  sponsorships and, emotional support and guidance.   The CHILDLINE number 1098 is a toll free number that is common in all the cities of India.  At present BSNL, Chennai Telephones, Vodaphone, Airtel, Aircel, Reliance Communication and TATA Indicom have provided free connectivity to ‘1098’. CHILDLINE is currently operational in 84 cities, which includes 10 cities in Tamil Nadu functioning at Chennai, Madurai, Tiruchirapalli, Coimbatore, Salem, Tirunelveli, Kanniyakumari, Cuddalore, Nagapattinam and Kancheepuram (Mahabalipuram), managed by the Non-Governmental Organisation with the financial support from the Government of India.  The Commissioner of Social Defence is the Chairperson of Childline Advisory Board of Chennai Childline.

 

CRISIS INTERVENTION CENTRE

One Crisis Intervention Centre on Child Abuse is functioning under ICCW Chennai as given in Annexure - VIII.

PROTECTION TO WOMEN AND GIRLS  UNDER IMMORAL TRAFFIC (PREVENTION) ACT 1956

            There are 5 Vigilance / Protective Homes and 6  Rescue shelters functioning under this department for the women victims of trafficking for commercial sexual exploitation. The victims rescued under Immoral Traffic (Prevention) Act 1956 IT(P) Act 1956 are  provided food, clothing, medical and health assistance,  counseling , vocational training, during their stay here.

            The victim women are restored to their legal guardians as per the court orders.

            A home for unmarried mothers is also housed in the campus of Government Vigilance Home and Stri Sadhana, Chennai.  List of Rescue Shelters and Vigilance/Protective homes are given Annexure - IX.

Financial rehabilitation assistance  for the women victims include -

  1. Cash assistance of Rs.5000/- (or) material assistance of  Rs.10,000/-  provided from the Tamil Nadu Social Defence Welfare Fund for Women and Children, to the women discharged from Vigilance / Protective Homes and Rescue Shelters
  2. Grant of Rs. 5000/- for  marriage  and arranging of marriages.

So far 153 women have benefited under the scheme.


STRANDED GIRLS AND UNMARRIED MOTHERS

The Department of Social Defence provides temporary care for the stranded girls through Non-Governmental Organisations. Counseling is provided to the girls to find out the reasons for their leaving their homes. Non-formal education and vocational training is also provided to these girls.

            Admissions are authorised by the Commissioner of Social Defence for a temporary period of 3 months,  extendable up to 6 months.

            Two Non-Governmental Organisations are assisted financially to maintain short stay homes for stranded girls. Addresses are given in Annexure - X.

WOMEN AND GIRLS IN MORAL DANGER

The Commissioner can order admission of women and girls who are in moral danger, and those who seek admission voluntarily in the Stri Sadana Rescue Home, Chennai for a maximum period of stay for three years. Facilities of Non-Formal education and Vocational Programme are made available through  the institution.

 

SCHEME FOR PROHIBITION AND DRUG ABUSE PREVENTION

UNDER GOVERNMENT OF INDIA ASSISTANCE

Objective

a)     To create awareness and educate people about the ill effects of alcoholism and substance abuse on the individual, the family,  the workplace and society at large;

b)     To provide for the whole range of community based services for identification, motivation, counselling, de-addiction, after care rehabilitation for Whole Person Recovery (WPR) of addicts;

c)      To alleviate the consequences of drug and alcohol dependence amongst the individual, the family and society at large;

d)     To facilitate research, training, documentation and collection of relevant information to strengthen the above mentioned objectives; and                 

e)     To support other activities which are in consonance with the mandate of the Ministry of Social Justice & Empowerment in this field.

Financial Assistance is available for:

v     Integrated Rehabilitation Centre for Addicts (IRCA).

v     Programme for Prevention of Alcoholism and Drug Abuse at Workplace (WPP).

v     Regional Resource and Training Centres (RRTC).

v     Awareness-cum-Deaddiction Camps (ACDC)

v     Technical Exchange and personal Development Programme.

v     Preventive Education and Awareness Generation through Media Publicity.

v     NGO Forum for Drug Abuse Prevention.

v     Innovative Intervention to Strengthen Community Based Rehabilitation.

v     Survey, Studies, Evaluation and Research on the subject covered under the Scheme.

.  There are 21 de-addiction programmes sanctioned by Government of India in 19 districts in 2007-2008 and  34 proposals covering 25 districts were sent for sanction in 2008-2009.

SWADHAR SCHEME

 

            The Department of Women and Child Development, Government of India during the year 2001-2002 had introduced a scheme “SWADHAR” to respond to the needs of women, especially for those in difficult circumstances like widows, destitute and deserted women, women ex-prisoner, victims of sexual abuse and crimes including those trafficked and rescued from brothels, migrants or refugees rendered homeless due to natural calamities, women victims of terrorist violence and the like.

            Under the Scheme 90% grant is given to NGOs, 10% is NGOs contribution.    The proposal of NGOs are received at Commissionerate of Social Defence, Chennai /Probation Officer in districts/the Zonal officer designated by the Commissioner of Social Defence.  The proposals after due verification / inspection are placed before the State Empowered Committee for recommendation to Government of India.

UJJAWALA SCHEME

 

The Ministry of Women and Child Development, Government of India during the year 2007-2008 had introduced A Comprehensive Scheme for Prevention of Trafficking and Rescue, Rehabilitation and Re-integration of Victims of Trafficking for Commercial Sexual Exploitation –“UJJAWALA” with an objective to:

The Commissioner of Social Defence is designated as Nodal Officer for scrutinizing, inspecting, recommending and forwarding the proposals received from NGOs to Government of India. NGOs have to submit their proposals to Commissionerate of Social Defence.

In the year 2007-2008, 15 proposals of NGOs have been recommended and forwarded to Government of India for sanction of financial assistance. The Government of India has approved 7 proposals and remaining proposals are  under process in Government of India. The list of these 7 is in Annexure XIII.In the year 2008-2009, 3 proposals have been recommended and forwarded to Government of India.


INFORMATION CELL

An information cell is functioning in the Commissionerate of Social Defence .Information about the services available for neglected children, children in conflict with law and women in moral danger can be had between 3 to 4 p.m. in the office of the Commissioner of Social Defence, 300, Purasawalkam High Road, Chennai 10 Telephone No.(044) 26426421, 26427022 & Fax No.26612989. Information about institutional programmes, leave, discharge on license, absolute discharge etc in respect of the children can also be had from the information cell. Public Relation Officer/ Assistant Director (Vocational Programme) may be contacted for such information services.

COMPLAINTS REDRESSAL PROCEDURES

            Complaints Redressal Procedure is available in the Commissionerate of Social Defence, The Deputy Director (Administration) of the Office of Director of Social Defence is the Vigilance Officer to receive the complaints either in person or by the post in name cover. Reply about the action taken will be communicated to the complainant within 30 days from the date of receipt of complaint.  The complaints will be received on all working days between 3 to 5 p.m. in the office of the Commissioner of Social Defence 300, Purasawalkam High Road, Chennai-10, Telephone No.(044) 26426421, 26427022, Fax No.26612989.
